How Michael F. Campopiano Can Help After a Dog Bite in New Bedford

Dog bite claims in New Bedford are governed by Massachusetts’s strict liability statute for attacks outside the owner’s enclosure. Despite the strong law, insurers still dispute the circumstances, argue provocation, and try to inflate the victim’s fault.

A dedicated New Bedford dog bite attorney from the Law Offices of Michael F. Campopiano can make all the difference. Our firm has spent nearly two decades fighting for injury victims across New Bedford and Massachusetts — from the first investigation through settlement or trial before the Bristol County Superior Court — recovering significant results for our clients.

You can count on our New Bedford attorneys to:

  • Conduct a rapid investigation of the scene along Route 18, Interstate 195, Kempton Street, Acushnet Avenue, County Street, and Purchase Street to preserve photographs, video, and physical evidence before it disappears
  • Establish strict liability under Massachusetts law for attacks outside the owner’s enclosure and counter provocation or trespass defenses
  • Document every injury through specialist evaluations — including plastic surgery and mental-health professionals for PTSD and scarring claims
  • Identify every available source of coverage — homeowner’s, renter’s, commercial, and landlord policies — to maximize recovery
  • Take your case to trial before the Bristol County Superior Court if insurers refuse fair compensation

Our priority is your full recovery. Call today at (401) 288-3888 to speak with a New Bedford dog bite attorney. Your consultation is 100% free, and you pay nothing unless we win.

Understanding Massachusetts Dog Bite Law in New Bedford

Massachusetts is a strict-liability dog bite state. Under MGL c.140 § 155, a dog’s owner or keeper is liable for injuries the dog causes, and you do not have to prove the dog had ever bitten before. The statute does not apply only if the victim was trespassing, committing another tort, or provoking the dog — and a child under seven is presumed to have done none of these.

Most New Bedford dog bite claims are paid by the owner’s homeowner’s or renter’s insurance. You generally have three years to file (MGL c.260 § 2A), and contested cases are tried before the Bristol County Superior Court.

Common Dog Bite Cases We Handle in New Bedford

Our firm represents clients injured in all types of dog bite cases throughout New Bedford, including:

  • Public-Place Attacks: Bites on sidewalks, parks, and other public areas — governed by strict liability.
  • Attacks on Another Person’s Property: Bites that occur while you were lawfully on someone else’s property.
  • Child Dog-Bite Injuries: Attacks on children, who often suffer facial and permanent scarring.
  • Delivery and Service Worker Attacks: Postal carriers, delivery drivers, and utility workers bitten on the job.
  • Knock-Down and Non-Bite Injuries: Injuries when a dog lunges or knocks a victim over.
  • Landlord-Liability Attacks: Cases where a landlord knew of a dangerous dog and failed to act.

What Compensation Can You Recover After a dog bite in New Bedford?

A serious injury can upend every part of your life. Under Massachusetts personal injury law, you have the right to pursue full compensation from those responsible. Damages may include:

  • Medical Expenses: Emergency room treatment, surgery, hospitalization, physical therapy, specialist care, prescription medications, and all follow-up treatment related to your injuries
  • Lost Wages and Reduced Earning Capacity: Income lost during recovery and long-term compensation if your injuries limit your ability to work
  • Pain and Suffering: Compensation for physical pain, emotional distress, anxiety, and reduced quality of life — recoverable in full under Massachusetts law with no cap
  • Future Medical Expenses: Projected costs for ongoing treatment, rehabilitation, and any future procedures your injuries require
  • Additional Related Expenses: In-home care, mobility devices, home modifications, and other costs caused by your condition

What to Do After a Dog Bite in New Bedford

The steps you take in the hours and days after your injury can make or break your claim. If you have been hurt in New Bedford:

  • Identify the dog and its owner, and report the attack to animal control
  • Document everything — photograph the scene, your injuries, and anything that contributed to the incident before it changes
  • Get the names and contact information of any witnesses
  • Seek medical attention the same day, even if you think you can wait — delayed treatment is used against you
  • Report the crash to your own insurer to activate PIP, but give no recorded statement to the other side’s insurer before speaking with an attorney

I had a great experience with the Law Office of Michael Campopiano. From start to finish, the entire team was supportive, knowledgeable, and attentive.

Rosie, my assigned paralegal, was excellent. She was always professional, responsive, and took the time to answer any questions or concerns I had throughout the process, which made everything much less stressful.

Corissa, the attorney, was also extremely helpful and informative. She made sure I understood each step and provided clear guidance along the way.

Michael was amazing as well, very involved in my case and genuinely cared about the outcome. It was clear that he and his team are dedicated to their clients.

Overall, I was very satisfied with the service I received and would highly recommend this office to anyone in need of legal assistance.

Frequently Asked Questions About Dog Bite in New Bedford

1. Is Massachusetts a strict liability state for dog bites?

Yes. Under MGL c.140 § 155, dog owners (and keepers) are strictly liable for injuries their dog causes — you do not have to prove the owner knew the dog was dangerous or was negligent.

The statute does not apply if the victim was trespassing, committing another tort, or provoking or tormenting the dog at the time. Outside those exceptions, the owner is liable regardless of the dog’s history.

It’s much harder. Massachusetts law presumes a child under 7 was not trespassing or provoking the dog, shifting the burden to the owner to prove otherwise. Young children are strongly protected under the statute.

Typically the owner’s homeowner’s or renter’s insurance. The claim is against the policy, not the person directly — so you can recover without going after a friend or neighbor personally.

Three years from the attack for most claims. For a minor, the period generally does not begin until the child turns 18 — but acting early preserves evidence and witnesses.

Possibly, under negligence (not strict liability). If a landlord knew of a tenant’s dangerous dog — for example from prior complaints — and failed to act, the landlord can share liability for an attack.

Value reflects the severity of the wounds, scarring and disfigurement (especially facial), surgery, infection, emotional trauma, and lost wages. Children’s facial-scarring cases often carry significant value.

Often yes. Section 155 covers damage “caused by” the dog, not just bites — so a dog that lunges, jumps, or knocks you over causing injury can trigger the owner’s liability.
