Under Rhode Island General Law 31-18-1, every driver must yield the right of way to a pedestrian crossing within any marked or unmarked crosswalk at an intersection when the pedestrian is in the driver’s half of the road or approaching closely enough to be in danger.
Rhode Island recognizes unmarked crosswalks at all intersections. At any intersection without painted lines, a pedestrian who steps into the road to cross at the corner has a legal right of way. Many drivers are unaware of this rule and fail to yield accordingly.
The Duty of Due Care — RI General Law 31-18-5
Even outside a crosswalk, Rhode Island law requires drivers to exercise due care to avoid colliding with any pedestrian. A pedestrian crossing mid-block does not lose all legal protection. The driver still has an obligation to observe what is in front of their vehicle and take reasonable action to avoid a collision. This does not eliminate the pedestrian’s comparative fault, but it means drivers cannot simply argue they had no duty because the pedestrian was outside a crosswalk.

Drivers making turns at intersections must yield to pedestrians who have a crossing signal or right of way. A pedestrian struck by a turning driver who failed to observe them has a straightforward liability claim.
