The Three-Phase Rideshare Insurance Framework
Phase 1: App Off — No Rideshare Coverage
When the Uber or Lyft driver has their app completely off, they are a private individual. Only their personal auto insurance policy applies. Uber and Lyft provide zero coverage in this phase.
Phase 2: App On, Waiting for a Ride Request
When the driver is available to accept rides but has not yet been matched with a passenger, limited commercial coverage applies:
- $50,000 per person for bodily injury
- $100,000 per accident for bodily injury
- $25,000 per accident for property damage
These limits are considerably lower than Phase 3 and may be insufficient for serious injuries. MFC Law investigates the app status through driver records and trip data obtained in discovery.
Phase 3: Active Trip — Full Commercial Coverage
Once the driver accepts a ride request and until the passenger is dropped off and the trip ends in the app:
- $1,000,000 in third-party liability coverage
- Uninsured/Underinsured Motorist coverage where required by state law
- Contingent collision and comprehensive for the driver vehicle subject to a deductible
The $1 million limit covers injuries to passengers, other drivers, pedestrians, and cyclists struck by the active rideshare vehicle.

How App Status Is Established
Driver App Records
Uber and Lyft maintain detailed records of every driver app activity: when the app was on, when a request was accepted, when the trip started, and when it ended. We obtain these records through the litigation process.
Police Report and Event Data
Police reports frequently note whether the driver identified as a rideshare driver and whether a passenger was present. Event data recorders capture speed and braking data that help reconstruct the timeline alongside the app records.
